Terms and Conditions

THE FUTURE IS GREATER LTD, SEMINAR & COACHING TERMS OF AGREEMENT.

Thank-you for choosing to work with The Future is Greater LTD hereafter referred to as Future is Greater. 

We are very excited to be working with you and look forward to our work together. We believe that each of our clients is a unique, creative and responsible person who is in charge of moving their own life forward.

By clicking “I Agree”, emailing your statement of agreement, entering your credit card information, or by signing this agreement, or otherwise enrolling, electronically, verbally, or otherwise, in the course, you (“Client”) are entering into a legally binding agreement with Future is Greater, according to the following terms and conditions: 

This agreement sets out the ground rules and practical arrangements for the advisory sessions between the coach and you the coachee. There are supplementary terms and conditions with explanatory notes that are attached to this coaching agreement, which also form part of the agreement. We encourage you to read it thoroughly as these supplementary terms and conditions are also legally binding on you.

This agreement, between you and Future is Greater will begin the date you accept this agreement and will continue for a period of at least 3 months ending on an approximate date of 3 Months after the agreement begins when all your sessions in the solution you are investing in are completed (subject to any rescheduling with 48 hours’ notice).

WHAT IS COACHING?

Coaching is a structure that facilitates the process of personal, professional and / or spiritual development through an ongoing relationship of trust between a coach and a client. Coaching is not advice, therapy or counselling and it does not treat mental disorders. Coaching may involve all areas of your life, including business, work, finances, health, relationships, education and recreation. Coaching is for individuals who are emotionally and psychologically healthy and who want to make changes and move forward in their lives.

COMPANY’S SERVICES

The responsibility of Future is Greater is to render coaching and advisory services (the “Program”) to you. Future is Greater reserves the right to substitute services equal to or comparable to the Program for you if the need arises.

 

OUR WORKING RELATIONSHIP

You and Future is Greater commit to working with each other by engaging in very direct and personal conversations for up to a three‐month period which will take place on zoom. Communications between you and Future is Greater will be tailored to your coaching needs.

If you have any past or present psychological or psychiatric treatment please do notify us immediately. Also, if at any point through our coaching relationship we identify the need for mental health treatment you agree to get the necessary treatment. 

DISCLAIMER OF GUARANTEE

In the coaching relationship, Future is Greater plays the role of a facilitator of change, but it is your full responsibility to enact or bring about the change. You understand that the power of the coaching relationship which can only be granted by you is effective when you do your best to reach YOUR desired outcome. If you see the coaching is not working as desired, you agree to communicate with us and take the necessary actions to return the power to the coaching relationship. 

RULES

You agree to abide by all the rules of Future is Greater including but not limited to your understanding to behave professionally, courteously, and respectfully with all staff and other clients of Future is Greater. The failure to abide by course rules shall be cause for termination of this Agreement and you will not be entitled to recoup any amounts paid and shall remain responsible for all outstanding amounts of the fee.

PRIVACY

You can, at any point in our sessions, declare your preference not to discuss a specific issue, by simply stating that you would rather not discuss this issue. Future is Greater agrees to respect this boundary and will not attempt to discuss the point any further.

Solution components

The package components for your solution will be shared with you.

An example is our 90-Day High Flyers Leadership Advisory and Executive Solution which has the following components:

  • Full client welcome packets reviewed by Future is Greater
  • Conative & Cognitive Assessments to uncover your strengths, leadership style, and instinctive ways of acting and gaps have your team fill
  • One (1) 75-minute Vision, clarity and priorities intensive session to kick off the solution and clarify the goals and plan we will help you work towards achieving
  • Five (5) 60-minute 1 on 1 sessions held fortnightly at mutually agreed times. 
  • One (1) bonus 75-minute solution wrap up and debrief session with Maxine to ensure continued success.
  • Note it is your responsibility to prioritize your solution components and sessions as they are scheduled for you. Future is Greater understands that unforeseen circumstances can arise hence the allowance for moving of sessions with a minimum of 48 hours’ notice.  However, all sessions must be used within one year of this agreement being signed.  You agree to forfeit any sessions not utilized within one year.  If Future is Greater needs to cancel due to unforeseen circumstances at our end, we will also give a minimum of 48 hours’ notice and the call will be rescheduled so you do not lose it. 

 

THE FEE

The fee investment for your particular solution and any payment plan options and dates will be shared with you in writing.  Note that our programs come with a “no refund policy” because we want you to know that every client who enrolls is just as dedicated as you to improving their lives and work. Future is Greater does not want to work with “on-the-fencers” because we believe how you do one thing is how you do everything; and these programs are only for clients who are willing and READY for transformation. If that’s you, then you are in a strong position to earn your investment back multiple times over. Payments must be made before the sessions are due to start.

WHEN PAYMENT MUST BE MADE

Payments must be paid at least 2 working days before the sessions are due to start. In the event that a payment plan option is selected, each payment instalment must be made before the start of that month's sessions and solution components.

It is also important to note that once you accept the terms in this coaching agreement, you are committing to partake in all the sessions and components that make up your solution.  They are specifically tailored to you, and you are therefore liable for the full investment amount stated whether you have chosen to pay for the full payment option or the instalment option. Therefore, even if you have selected the instalment option you agree and are liable to pay for the full number of sessions  and components in your chosen package according to the payment option selected and at the set times whether you decided to stop the using our services or not. 

Please provide your payment Card(s) information for payment on your account. Future is Greater shall charge your Card(s) for any unpaid charges on the dates agreed. If payment is not made, a 5% (five-percent) late penalty charge will be made to all balances that are not paid in on time on the registered card number and you will still be charged for that session, however, that particular coaching session will not take place.

LATENESS FOR THE COACHING SESSION

You and Future is Greater commit to starting and finishing each session on time. In the event you are going to be late for the coaching session, please do inform your coach as soon as possible by email at [email protected]

If for any unfortunate reason you more than 15 mins late we will have no other option but to assume the session is cancelled and unfortunately you will forfeit the session fee. As a result, you will have lost one coaching session from the total number of sessions and that session cannot be replaced. An option will be available to you to make additional payments at £500 per session for any extra sessions missed at the end of the initial sessions in your solution.

CANCELLATIONS

We look forward to every session with you and we hope that you will have no cause to cancel. In the event you need to cancel the coaching session, please do so in the scheduling system that you will be provided to schedule your sessions at least 48 hours before that particular session. If for any reason you cannot access that system and cancel the session there then please ensure that you email Future is Greater at [email protected] with your request to cancel, and that you wish to book another session and your fee for that session will be preserved. Please see the supplementary terms and conditions for clarification of what constitutes “confirmation of cancellation of a session”. 

It is important to note that your coaching sessions must all be completed within 12 months of the start date of this agreement. Any sessions which have not been completed by the end of this time period will be forfeited. 

 

MATERIAL FOR THE COACHING SESSIONS

All material is under the full ownership of Future is Greater. We will make available all the material you need for the coaching session and will record the sessions and can provide a recording of that session to you if you wish. We record the sessions so that we can make references to what was stated during our sessions in order to make further progress in the coaching session. If you are uncomfortable with being recorded please do let us know. You agree to not record the sessions or make duplications of any material for yourself or making a reproduction of them for use or similar profit for yourself or others.

INTELLECTUAL PROPERTY

Future is Greater copyrighted and original materials shall be provided to you for your individual use only as a single-user license. You are prohibited from any use of any of the intellectual property of Future is Greater for your business purposes. 

TERMINATION

In the event that a party wishes to terminate the coaching they shall give two weeks’ notice. Otherwise, the coaching will continue for the duration of the contracted period. 

In the event that you are in arrears of payment or otherwise in default of this Agreement, all payments due shall be immediately payable.

 

FURTHER COACHING 

Once the coaching package is completed, we will review our agreement. There will be other options available to agree new terms to continue or terminate the coaching relationship.

GOVERNING LAW

It is our hope that our relationship is fruitful and productive and most of all to the satisfaction of both parties. In the event that a dispute arises between us which cannot be resolved without court proceedings, this Agreement shall be governed by and construed in accordance with the laws of the United Kingdom in the foremost and thereafter if and where necessary the relevant European Law, without regard to or application of its conflict of law provisions of your state or country of residence. 

If anyone brings a claim against Future is Greater related to your actions whether or not advised by Future is Greater or not, you will indemnify and hold Future is Greater harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. 

 

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Future is Greater, any future shareholders, trustees, affiliates, and successors from and against any and all liabilities and expense. This agreement includes without limitation, claims, damages, judgments, awards, settlements, investigations, costs, attorney’s fees, and disbursements - which may incur or may become an obligation to pay as a result of the offering for sale, the sale, and/or use of the product(s). 

LIMITATION OF LIABILITY

By using the services of Future is Greater and enrolling in the Program, you release Future is Greater, its officers, employers, directors, and related entities from any and all damages that may result from anything and everything. You accept any and all risks, foreseeable or non-foreseeable; arising from such transactions use of the services of Future is Greater. 

CONFIDENTIALITY

The coaching relationship is built on trust. Future is Greater will work within the professional ethics and guidelines. All information about our coaching relationship will remain strictly confidential except in very rare circumstances where decreed by law. However, nothing in this agreement is intended to limit any legal defences or objections that you may have to a third party’s or government’s request to disclose your information.

Future is Greater also reserves the right to seek second opinions from other certified coaches or professionals if we deem it necessary and to record our conversations for our training purposes. 

CONTROLLING AGREEMENT

In the event of any conflict between the provisions contained in this contract and any marketing materials used by Future is Greater, our representatives, or employees, the provisions in this Agreement shall be controlling. 

FURTHER INFORMATION

For further information on the Entire Agreement, Survivability, Severability, Non-Disparagement, Language of Agreement, Risk, Communications and Responsibility for dialling into a call, please see the supplementary terms and conditions.

YOUR CONFIRMATION AND ACCEPTANCE

You confirm that you are fully competent and able to understand this Agreement and supplementary Terms and Conditions of Service before accepting it and that there are no medical conditions, physical, intellectual or mental impairments which affect your comprehension and understanding of this Agreement and supplementary Terms and Conditions of Service. 

If you are unsure about your position and the use or access of our Services please seek legal advice before using or accessing the Service.

Upon execution by clicking that you accept these terms, you agree that you shall be legally bound by the terms of THIS AGREEMENT and supplementary Terms and Conditions of Service. Clicking that you accept constitutes a legal and binding instrument with the same effect as an originally signed copy.

SUPPLEMENTARY TERMS AND CONDITIONS WITH EXPLANATORY NOTES

WHAT IS COACHING?

Coaching may address specific personal projects, business successes, or general conditions in your life or profession. Other coaching services include value clarification, brainstorming, identifying plans of action, and examining modes of operating in life, asking clarifying questions, and making empowering requests or suggestions for action. 

Feelings are a normal and healthy part of being human and through a coaching relationship, awareness and curiosity will be brought to your feelings so that you can take the full responsibility to make more informed choices and move into your desired action. 

The opportunity for success for the coaching client dramatically increases because changing habits and creating possibilities is a process. You agree with Future is Greater that the coaching relationship will be designed together. You acknowledge that it is exclusively your responsibility to decide how to handle the issues that surface during the coaching relationship and how you implement your choices

Coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and you will not use it in place of any form of therapy. You understand that coaching does not deal with the psychological antecedent to emotions, which is the realm of therapy. 

COMPANY’S SERVICES

The terms of the contract shall be binding on you for any further goods/services supplied to you by Future is Greater. The parties agree that the Program is in the nature of coaching and in some cases it will have an educational aspect. The scope of services rendered by Future is Greater in relation to this contract shall be solely limited to those services specified in the contract agreement and provided for on the website of Future is Greater. Future is Greater reserves the right to substitute services equal to or comparable to the Program for you if the need arises. 

OUR WORKING RELATIONSHIP

By entering this relationship, you and Future is Greater acknowledge that your desire is to make significant progress and change in your life. This will happen at a rate that is unique to you. Our coaching packages, allow the coaching relationship the necessary time to develop and progress through objectives, obstacles and successes that occur. We assure you that we will speak in a language you understand and be honest and straightforward, ask clarifying questions and make empowering requests. 

You agree that if you currently are in therapy or otherwise under the care of a mental health professional, that you have consulted with this person regarding the advisability of working with a coach and that this person is aware of your decision to proceed with the coaching relationship. You also agree to disclose details of the past or present psychological or psychiatric treatment. In entering into the coaching relationship, and signing the agreement, you are agreeing that if any mental health difficulties arise during the course of the coaching relationship, you will notify us immediately so that we can discuss with you an appropriate referral. 

 

DISCLAIMER OF GUARANTEE

The purpose of our conversation is to keep your focus on YOUR desired outcome and to coach you to stay clear, focused and in action. You understand that successful coaching requires a co-active collaborative approach between you and Future is Greater. You accept and agree that you are 100% responsible for your progress and results from the Program. 

You accept and agree that you are the one vital element to the Program’s success and that Future is Greater cannot control you. Future is Greater makes no representations or guarantees, whether verbally or in writing regarding performance of this Agreement other than those specifically stated in this Agreement. Future is Greater and its affiliates disclaim the implied warranties of titles, merchant ability, and fitness for a particular purpose. Future is Greater makes no guarantee or warranty that the Program will meet your requirements or that all clients will achieve the same results.

 

 

RESPONSIBILITY FOR MAKING THE CALL

The virtual sessions will be conducted by Zoom where you and Future is Greater will both dial into the line or connect via the internet. Although experience dictates that it is more likely that we will be the first party to dial in or connect and will wait for you, it may not always be the case. 

COMMUNICATIONS

This section defines how and when communications take place between you and Future is Greater. Communications between you and Future is Greater will be tailored to your coaching needs.

(Discussed in the section “our working relationship” in the Agreement document) 

LATENESS FOR THE COACHING SESSION

We appreciate that there may be occasions when you may be late for the coaching session. 

We will always aim to be on time for each coaching session and we expect you to do the same. Also, it is important to note that there is much work to get done during each coaching session and each minute is valuable. 

We usually book a 1-hour time slot for each coaching session, after the initial strategy session, thus if you are late unfortunately we are unable to offer the full 1-hour coaching time. For example, if Mr Joe Bloggs is 15 mins late for the coaching session which begins at 1pm and ends at 2:00pm, only the remainder of the 45-minute session which ends at 2:00pm will be available to Mr Joe Bloggs.

CANCELLATIONS

Please note that any payment made for the sessions will be non-refundable as that specific time was reserved for you only. It is also important to remember that once you confirm in writing that you wish to cancel that particular session we may not be available for that particular time slot for coaching. If you confirm your cancellation within 48 hours of the next session, you will be given the opportunity to arrange a different time slot without losing the money you have paid for that session. 

In terms of the words that constitutes a cancelation of the coaching session, words to the effect of “I wish to cancel the following coaching session on ………… (name a particular date) will be accepted. 

Please note that words to the effect of “I may wish to cancel, I am thinking of cancelling, I may have to cancel in due course” or similar phrases which creates an ambiguity as to whether you are requesting an actual cancellation will not be deemed as a cancellation of that particular coaching session. If due to any ambiguity the session is cancelled in any event you will have forfeited your money and lost that session without a chance to swap it for another session. Therefore, we encourage you to be very clear in your wording.

MATERIAL FOR THE COACHING SESSIONS

You agree to recordings being made of courses and the Program. Future is Greater reserves the right to use, at its sole discretion, course materials, videos and audio recordings of courses, and materials submitted by you or to you in the context of the course(s) and the Program for future lecture, teaching, and marketing materials, and further other goods/services provided by Future is Greater, without compensation to you. 

You consent to your name, voice, and likeness being used by Future is Greater, for future lectures, teaching, and marketing materials, and further other goods/services provided by Future is Greater, without compensation to you.

All documents, material and any other information we provide to you is for your sole use and not for the use or reference for any other person. You agree not to reproduce, duplicate, copy, sell, trade, resell, give with or without financial gain, or exploit for any commercial purposes, any portion of the Program (including course materials), use of the Program, or access to the Program. The agreement is not transferrable or assignable with Future is Greater, without our prior written consent. 

INTELLECTUAL PROPERTY

You are prohibited from sharing; copying, distributing, or otherwise disseminating any materials received from Future is Greater electronically or otherwise without the prior written consent of Future is Greater. All intellectual property, including the copyrighted course materials of Future is Greater, shall remain the sole property of Future is Greater. No license to sell or distribute materials of Future is Greater is granted or implied. 

GOVERNING LAW

All claims, legal proceedings or litigation arising in connection with the Services we provide and the terms and conditions of our agreement will be brought solely in the country of the United Kingdom, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum or jurisdiction.

The parties agree to submit any dispute or controversy arising out of or relating to the Agreement to arbitration in the country of the United Kingdom pursuant to the rules of the United Kingdom Arbitration Association, which arbitration shall be binding upon the parties and their successors in interest. If necessary as a last resort, when all United Kingdom Court processes have been exhausted, the matter will be heard under the relevant European legislation. The winning party is entitled to be reimbursed for all reasonable legal fees from the losing party in order to enforce the provisions of the Agreement.

 

INDEMNIFICATION

Future is Greater is liable for any such expenses and liabilities which may result from a breach of the Agreement or sole negligence or willful misconduct by Future is Greater, or any of its future shareholders, trustees, affiliates or successors. 

You agree to defend Future is Greater in any legal actions, regulatory actions, or the like arising from or related to the Agreement. Future is Greater recognizes and agrees that all of the shareholders, trustees, affiliates and successors of Future is Greater shall not be held personally responsible or liable for any actions or representations of Future is Greater. 

LIMITATION OF LIABILITY

The Program is only a coaching service and in future it will provide an education service. Regardless of the previous paragraph, if Future is Greater is found to be liable, our liability to you or to any third party is limited to the lesser of (a) the total fees you paid to Future is Greater in the one month prior to the action giving rise to the liability, and (b) £1000. All claims against Future is Greater must be lodged with the entity having jurisdiction within 100-day of the date of the first claim or otherwise be forfeited forever. You agree that Future is Greater will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the services of Future is Greater or enrolment in the Program. You agree that use of the services of Future is Greater is at your own risk

 

RISK

It is also important to note that in some situations there might be a risk in using certain media / technology such as the internet, mobile phones and cordless phones in our communications.

CONFIDENTIALITY

The term “Confidential Information” shall mean information which is not generally known to the public relating to your business or personal affairs.  In such circumstances Future is Greater may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request to protect the safety of any person; to detect, prevent and address fraud, and other illegal activity; or to protect rights or property of Future is Greater. Exceptions to confidentiality of course relate to circumstances such as intent to seriously harm someone, child abuse etc. 

Future is Greater will endeavour to keep all information shared by you strictly confidential, however, notwithstanding anything to the contrary in this agreement, Future is Greater may disclose information if required by law: i.e. where the court might issue a summons/subpoena for the file or information.  Future is Greater may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena/summons) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United Kingdom where we have a good faith belief that the response is required by law in that jurisdiction and is consistent with internationally recognised standards. 

Future is Greater agrees not to disclose, reveal or make use of any confidential information learned of through its transactions with you, during discussion with you and the coaching session with Future is Greater. No personal ideas, information or thoughts expressed will be shared with anyone except with your written consent. Future is Greater shall keep the confidential information you give in strictest confidence and shall use its best efforts to safeguard your confidential information and to protect it against disclosure, misuse, espionage, loss and theft.   We also may retain information from accounts disabled for violations of our terms for at least a year to prevent repeat abuse or other violations of our terms. 

NON - DISPARAGEMENT

In the event that a dispute arises between the parties or a grievance by you, the parties agree and accept that the only venue for resolving such a dispute shall be in the venue chosen by Future is Greater. In the event of a dispute between the parties, the parties agree that they neither will engage in any conduct or communications, public or private, designed to disparage the other.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Future is Greater in relation to our coaching relationship and supersedes all prior and contemporaneous agreements, negotiations and understandings, oral or written. This Agreement may be modified only by an instrument in writing duly executed by both parties. 

SURVIVABILITY

The ownership, non-circumvention, non-disparagement, proprietary rights, and confidentiality provisions, and any provisions relating to payment of sums owed specified in this Agreement, and any other provisions that by their nature and context Future is Greater intends to continue, shall continue beyond the termination of this Agreement for any reason. 

SEVERABILITY

If any of the provisions contained in this Agreement, or any part of them, is later construed to be invalid or unenforceable, the same shall not affect the remainder of such provision or any other provision contained in the Agreement, which shall be given full effect regardless of the invalid provision or part thereof.

 

LANGUAGE OF THE AGREEMENT

This agreement was written in English (UK). To the extent any translated version of the agreement conflicts with the English version, the English version controls. 

YOUR CONFIRMATION AND ACCEPTANCE

By clicking that you accept, signing this agreement, making your payment, or otherwise enrolling, electronically or otherwise, in the course, you the Client are entering into a legally binding agreement with Future is Greater (“Coach”).  You agree to keep your agreements, to regard our appointment time frames with respect and to keep us informed as to what is needed to keep you moving forward. Your signing of this agreement indicates full understanding and agreement with the information outlined above.
